1. About us

This online store (thirstypotco.com) is operated as Thirsty Pot Co. by Vasyl Ivanys (sole trader, Czech Republic), Nový Malín 39, 788 03, Czech Republic ("we", "us", "our"). Contact: thirstypotco@email.cz. Our store runs on the Shopify platform.

By browsing the store or placing an order, you agree to these Terms of Service. Please also read our Privacy Policy, Shipping and Returns & Refunds pages, which form part of these terms.

2. Your rights under the Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited. If any part of these terms appears to do so, it does not apply to the extent of that conflict.

3. Who can order

We currently sell and deliver to addresses in Australia only. You must be at least 18 years old, or have a parent or guardian's permission, to place an order.

4. Products and descriptions

We work hard to describe products accurately, including their specifications and any limitations. Product information is based on manufacturer and supplier specifications. Colours on screen and hand-measured dimensions may vary slightly. If a product you receive is materially different from its description, you have the rights set out in section 2 and on our Returns & Refunds page.

We don't make the products we sell. They are supplied by third-party suppliers and shipped from warehouses in Australia. As the seller, we remain responsible to you for your order.

5. Prices and payment

All prices are in Australian dollars (AUD).
Standard delivery within Australia is free unless shown otherwise at checkout.
The total you pay is shown at checkout before you confirm your order.
Payment is processed securely by our payment providers. We do not see or store your full card details.
If we've made an obvious pricing error, we'll contact you before we ship and you can choose to go ahead at the correct price or cancel for a full refund.

6. Orders

When you place an order, you'll receive an order confirmation email. A contract is formed when we confirm your order. We may decline or cancel an order (for example if an item is unavailable, we can't deliver to your address, or we suspect fraud). If we do, we'll let you know and refund any amount you've paid in full.

You can ask to cancel an order by emailing us. If it hasn't shipped yet, we'll cancel it and refund you in full. If it has shipped, our change-of-mind returns policy applies.

7. Delivery

Delivery times shown on our site are estimates. See our Shipping page for details. Risk in the goods passes to you on delivery.

9. Using our website

You agree not to misuse the website: no attempting to interfere with its operation, gain unauthorised access, or use it for any unlawful purpose. Content on this website (text, graphics, logos and our product descriptions) belongs to us or our licensors, and you may not copy it for commercial use without permission. Some product images are supplied by our suppliers or manufacturers.

Our site may link to third-party websites. We're not responsible for their content or practices.

10. Liability

Subject to section 2, and to the extent permitted by law, we are not liable for loss or damage that was not reasonably foreseeable, or that was caused by misuse of a product or by failing to follow its instructions. Where the law allows us to limit our liability for goods that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited to replacing or repairing the goods or refunding the price paid.

We handle your personal information as described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of the Czech Republic. If you are a consumer in Australia, this does not take away any protection you have under the Australian Consumer Law or other Australian laws that cannot be excluded, and you may bring a claim in Australia.
